If you have a serious and are having difficulties resolving it, the small claims court may help. However, court action only becomes a preferred option once you have exhausted all other options to resolve the dispute.

Small claims court dispute is ideal for cases less than £10,000. The small claims court is a low-hassle way to take legal action for cases that don't need an attorney.

How to File Complaints in Small Claims Court by Yourself

The following are the steps to file a complaint in a UK small claims court:

  1. Write the defendant a letter before action: Most judges want you to prove you made a genuine effort to resolve the matter outside the court. It is best to write the defendant a letter of complaint stating your damages and asking them to resolve the issue urgently.
  2. If you don't receive a satisfactory response, prepare for the case by collecting relevant evidence, including receipts, photos, videos, or witness statements.
  3. Start your claim by visiting the court and filling out a form (N1). In the section labelled particulars of claim, describe in detail the claim you are making.
  4. Submit the form to the court clerk for processing. Deliver two copies of duly filled forms along with the court fees due. The fee payable depends on the value of your claim.
  5. Once the court receives the form, it will serve it to the defendant by mailing it to them by first class. The defendant will then decide to defend the case or not.
  6. The court schedules a hearing and informs both parties.
