Other Ways to File a Bellway Complaint

Most home builders belong to an association that can help you start the complaint process if you have not been able to resolve the dispute with the builder. Bellway is a member of the Home Builders Federation; however, the association does not accept complaints. The HBF only operates in England and Wales.

For homes in Scotland, contact the Scottish Building Federation for more information. Other associations to contact include:

Contacting a home builder association is a way to let the contractor know that you wish to pursue a formal complaint process. Complaint filings impact a builder's reputation so they may be more willing to resolve a dispute. If the problem remains unresolved, you can consider one of the following options:

Adjudication

The Consumer Code for Home Builders oversees the implementation and enforcement of home building standards. It is an independent body that uses adjudication to resolve disputes. To begin the process of the Independent Dispute Resolution Scheme, contact the Consumer Code for Home Builders.

Complaints cannot be filed after two years from the date of the Home Warranty Body's insurance certificate and the maximum award is £15,000. If you are dissatisfied with the results, you may pursue alternative dispute resolution, ombudsman, or small claims court.

Alternative Dispute Resolution (ADR)

Numerous ADR providers for home builder disputes exist throughout the UK. The Citizens Advice organization has a list of ADR providers and the services they offer. Agreeing to an ADR scheme means that no further action can be taken once the decision is made.

Ombudsman

Ombudspersons are available to address home building complaints. For more information, see the fact sheet located at New Homes Ombudsman. An ombudsperson's decision is final and may not be pursued in small claims court.

Small Claims Court

You will need documentation that you have attempted to resolve the complaint without success to appear in small claims court. Small claims court does have a maximum award ceiling. If the award amount you are requesting exceeds the small claims court ceiling, you can pursue other action.
