The Nuts and Bolts of the NSA FOIA Requests

The Freedom of Information Act of 1966 (FOIA) states that the workings of federal agencies, such as the CIA, FBI, IRS, or FDA, should be public knowledge. The National Security Agency (NSA) is one of many U.S. federal agencies obligated to release public records on request.

The NSA FOIA rules are simple, but you must follow them to a tee if you want to receive the desired documents fast. DoNotPay will explain how to write a bullet-proof NSA FOIA request letter and receive any NSA public record in no time!

The Freedom Of Information Act—The NSA Policy

The NSA states that they intend to inform the public of their actions and decisions to the fullest extent. To achieve that, NSA has:

  • Established a FOIA Service Center to handle requests
  • Appointed a FOIA Public Liaison Officer that the requesters can contact if they have questions or concerns
  • Publicly released relevant information about the agency's missions and functions

Before you file an NSA FOIA request letter, you should know that some records are off-limits. The FOIA categorizes those documents as exemptions and allows agencies like the NSA to withhold them. There are nine exemptions overall, but the first seven refer specifically to the workings of the NSA. They involve:

  1. Documents pertaining to national security
  2. Information about NSA internal practices
  3. Data that other federal laws protect from disclosure
  4. Files containing trade secrets or other classified financial information
  5. Communication between two agencies protected by the attorney-client, attorney work-product, or Deliberative Process privilege
  6. Information that could endanger an individual’s privacy if disclosed
  7. Files collected for law-enforcement purposes

The Privacy Act

The Privacy Act is designed to protect personal privacy by stopping the unauthorized disclosure of personal records. At the same time, a person can request to see a record on themselves if they provide an identification document. All such requests are processed in compliance with both the PA and FOIA.

How To Submit an NSA FOIA Request Letter

Before you submit your NSA FOIA request letter, you should check the NSA official website for frequently requested information. There is a chance the documents you seek have already been publicly released.

NSA doesn’t offer any FOIA request letter templates that you can use. The agency does point out the importance of being specific about the information you seek. The NSA will return any request with insufficient information and ask you to clarify it.

If you are making a request under the Privacy Act, you must provide as many record details as you can. Your request must contain a personal identifier and a digital signature to be accepted.

There are a few methods of submitting your FOIA and Privacy Act requests to the NSA. Take a look at the table below for more details:
