Parental leave and time off for parents is a trending topic, getting more attention through the US as time goes on. Many other developed countries have robust policies that allow new parents time off to prepare for the new addition to their family, and to allow them time to bond with the child after birth.
These parental leave policies also allow for other family emergencies like caring for service members or immediate family members who become suddenly and severely ill.
The US does have the Family and Maternity Leave Act. But it only covers some employees of larger companies. And it only provides minimal time off compared to what many other countries extend to their citizens.
Some states have no requirements at all for family leave or maternity leave for small businesses or other entities that hire workers.
Who is Eligible for Parental Leave at UCSF in San Diego, California?
California does have a fairly robust parental leave option and allowance for employees. Many employees will be covered by these statutes, but there are some employees who remain without coverage.
You must meet the following criteria in order to be covered for leave:
- Working for a private sector company with 50 or more employees
- Working for a public sector company (of any size)
- Have been employed by that employer for 12 months
- Worked at least 1,250 hours in the last year
If a worker meets these criteria, they are able to get up to 6 weeks of paid family medical leave through the state in certain situations. These situations include taking care of a critically ill immediate family member or taking time off to spend and bond with a new child.
What Are the Parental Leave Laws in California?
California is one of the few states that have fairly robust parental leave options and allowances for employees working within the state. California does provide State Family and Medical Leave, which is paid in some situations and in other situations is unpaid.
The following explains the leave you are entitled to under California law when a company in the private sector has more than 50 employees, or any company is considered part of the public sector:

Unpaid Leave
Employers must offer up to 12 weeks of unpaid family leave plus an additional 4 months of maternity leave for up to a combined total of 28 weeks of leave per year.

Paid Leave
The California Paid Family Leave insurance program applies to all employees who have worked for the company for at least 12 months before the leave and have worked 1,250 hours in the past year.
These employees are entitled to up to 6 weeks of paid leave in order to care for a seriously ill child, spouse, parent, or registered domestic partner. It also qualifies to allow an employee time to bond with a new child.
These laws are in place for California. They provide a lot more family time and leeway to employees than some other states. However, not all employees are covered under these guidelines. Many are left without options to help their families in a time of need or crisis.
Who is Eligible for Parental Leave in California?
Anyone who works for a private employer with more than 50 employees is eligible to partake in the California Paid Family Leave. Any employee of a public sector company is also able to get these benefits.
Employees of both public and private sector companies must be employed at a company for at least 12 months and have worked 1,250 hours in the last year leading up to their leave in order to qualify.
Do I Qualify for the FMLA Program?
Moreover, some individuals will qualify for the federal program called the Family and Medical Leave Act (FMLA). This program applies to residents in all 50 states and allows you to take family leave for a variety of reasons if you meet certain criteria.
However, not all employees meet the criteria to qualify for the program.
The following are requirements that must met in order to get coverage through the US federal government:
- The birth of a child, or caring for a newborn child within one year of birth
- The placement of a child for adoption or foster care by the employee within the last year
- To care for the employee's spouse, parent or child with a serious illness
- A serious health condition that leaves them unable to perform essential functions of their jobs
- Any qualifying exigency arising out of the fact that the employee's spouse, son, daughter, or parent is a covered military member on "covered active duty”
The FMLA program caps an employee's time each year at a maximum of 6 weeks per year during any 12-month period of time. Your requests for time off must also be for one of the aforementioned reasons.
In order to qualify for the federal program, as an employee you must meet the following criteria:
- Work for a covered employer
- Have worked 1250 hours during the 12 months prior to the start of the leave.
- Work at a company with 50 or more employees working or within 75 miles of it
- Have worked for the employer for 12 months prior to taking leave
Since many employees do not meet these requirements in order to qualify for FMLA leave, many individuals are left without the ability to take paid leave when they become a parent or welcome new additions to their families.

The workshop helps each employee create a personalized plan for their leave and allows them to know what to do before, during, and after their leave in order to remain in good standing and return to their job after their child is born.
