What is FMLA?

The Family Medical Leave Act (FMLA) is a federal law that was passed in 1993 that requires employers to grant their employees time off of work to take care of medical and family issues. Under this law, new parents are allowed to take a leave of absence from work for up to 12 weeks after their child is born. This also applies to adoptive parents and foster parents as well.

Who is Eligible for FMLA?

Not everyone will automatically qualify for FMLA leave. In order to qualify, a worker must:

  • Work at a location that has 50 or more employees
  • Have worked for at least 1,250 hours in the last 12 months
  • Have worked for your current employer for at least 12 months.

The 12-month work requirement does not have to be consecutive. For example, you can work for the employer for two months, leave the job for a year, and come back and work for 10 more months. However, if the break was longer than seven years, the previous work history will not count towards the 12-month work requirement.
