City of Atlanta Dog Bite Laws

Georgia's dog biting regulations are complex. The legislation allows for a somewhat modified "one bite" rule, in which a dog owner may be exempt from blame for their dog's first bite if specific conditions are followed. To put it simply, for a dog owner to be found accountable for their dog's assault on another person, the plaintiff must demonstrate:

  • The dog was nasty or dangerous.
  • The dog's owner was aware of its threat to other people.
  • The victim of a dog bite did not provoke the dog.

Dog bite liability is easier to establish if the dog is not leashed correctly. All dogs must be leashed in Georgia unless they are on their property or in a designated off-leash dog park. Even at off-leash dog parks, dog owners must keep an eye on their pets and retain vocal control over the off-leash dog at all times.

If a dog at an off-leash dog park exhibits hostile behavior, the owner promptly removes the animal. Other laws against violent dogs exist in Georgia and certain city governments. Owners are restricted to one violent dog per breed (which varies by city), and such owners must additionally obtain supplementary liability insurance.
