Who Is Liable If a Dog Bites Someone?

The Texas laws related to dog bites include portions of Texas Health and Safety Code Section 822.005, Section 822.042, and Section 822.044, with additional information in Texas Penal Code Section 6.03 and Texas Civil Code Section 16.003.

Unlike most states, Texas gives dog owners a lot of leeway in the event their animal bites someone. Dog owners are often not considered liable for the bite unless the victim can prove that the owner is at least 50% at fault for the bite. Essentially, this would mean proving that you didn't do anything to provoke the animal. You would also lose out if you happened to be on the owner's property, near the animal's enclosure or cage, or were part of a dog training exercise, or other lines of work where being bitten is considered a reasonable expectation.

This isn't true for dogs with a history of biting people though. Unlike in normal circumstances, if a dog has bitten someone in the past or displayed a history of aggressive behavior, the owner is meant to take precautions against the animal hurting people. If they display negligent behavior and someone gets hurt, they are much more likely to be found liable for the damages.
