WePay's Terms of Service: What You Need To Know
Today, the demand for seamless payment options is on the rise. WePay focuses on addressing this issue by delivering payments that one can bank on. Access to flexible, integrated payments via referral is possible through WePay payment facilitator models, APIs, or white label.
That, in turn, allows users to focus on activities that matter most to them. So, if you are looking for a reliable payment solution, you can consider this option and remember to review WePay terms of service beforehand as well. Additionally, if you need help analyzing terms and services, DoNotPay can help you with that.
Understanding WePay Terms of Service
One of the aspects covered within the WePay terms of service is the E-Sign Disclosure and Consent (Electronic Delivery). Embracing WePay terms of service means that you agree and consent to receive electronically all disclosures, communications, notices, agreements, and documents that the platform provides relating to your account and your use of the service.
Communications include but are not limited to the following.
- Federal and state tax statements (Note that WePay is not obligated to send tax-related information electronically.)
- Policies and agreements
- Account statements and history
- Annual disclosures
- Communication relating to delinquent accounts
WePay sends you these communications by:
- Posting them on the website
- Emailing them using the primary address listed in your account registration
- Texting or emailing you a link or instructions on accessing the communication on a website
- Texting them at the primary telephone number listed in your account registration
WePay may also send you communication to the street address listed in your account registration. Understand that the company will consider communications received within 24 hours of being mailed, emailed, or posted to you on the website.
Additionally, accepting these terms implies that you agree that your electronic signature will have the same effect as your manual, physical signature.
Categories of Activities That WePay Terms of Service Prohibit
Once you register as a merchant with WePay, you confirm that you will not accept payments or use the service with the services, activities, or items below.
- Travel
You should not use WePay services for travel industry operations, including lodgings and car rentals. Using WePay for airline-related activities, travel agencies, cruise lines, and steamships is also prohibited.
- Adult
WePay services should not be used for massage parlors, adult sites, mail order brides, content, escort services, sexual services, bestiality, child pornography, or dating services.
- Telecommunications
Using WePay for telecommunications, including ISP, wireless, wireline, cable, and satellite, is prohibited.

You should not use WePay as a payment facilitator to other merchants.
- Regulated Products

Limitations on the Responsibility of WePay and Other Third Parties
WePay, the bank, or any other third-party cannot guarantee or represent purchases or merchants using the service. Understand that using the service is not an endorsement by WePay or any card network of a user's beliefs, existence, practices, legitimacy, policies, or ability.
Also, WePay does not have liability for or control of goods or services paid for with the service. The merchant also agrees and acknowledges that receipt of purchaser information via the service does not indicate that the purchaser's payment instrument has sufficient available funds.
WePay allows nonprofits to accept payments as a merchant. However, not all contributions to nonprofit entities are tax-deductible, and not all nonprofits are tax-exempt. For that reason, nonprofit organizations bear the responsibility of correctly classifying themselves and their transactions.
Also, contributors should verify the status of organizations to which they donate and report their donations correctly for tax, among other things.
