Charlotte Dog Bite Laws

Charlotte has several statutes related to dog bites that can lead to dog owners facing liability if their dog has bitten another person. Section 67 of the North Carolina General Statutes states that a victim of a dog bite can show that a dog was liable for a dog bite if:

  1. They can prove that the dog was dangerous.
  2. The dog injured a person.
  3. The dog damaged another person's property.

It's important for dog owners in Charlotte to know that North Carolina places strict liability on dog owners for dog bites in the event that the dog owner is aware of their dog's dangerous tendencies.  However, dog owners that are unaware that their dog has dangerous tendencies are protected by the "One Bite Rule". This protects dog owners from liability if they can prove that they have no reason to believe that their dog is a threat to citizens and other dogs.

What is Considered a Dangerous Dog?

A dangerous dog, as defined by the North Carolina General Statutes, includes the following:

  • A dog that has killed or inflicted injury on another individual without being provoked
  • A dog that is determined by the person or board designated by the municipal authority to be potentially dangerous as determined by the fact that the dog has engaged in one or more outlined in subsection (2).
  • Any dog that was obtained for the sole purpose of dogfighting or any dog trained for such activities
