Understanding Debt Validation Letters

Before you pay any amount to a debt collector, you must confirm that the debt belongs to you. The Fair Debt Collection Practice Act requires collections agencies to provide certain information:

  1. Name of the alleged debtor
  2. Name and address of the alleged creditor
  3. Outstanding debt
  4. Date the debt became payable
  5. Your right to dispute the debt within 30 days of contact
  6. That they must send written proof of debt if you dispute the debt in writing

Collections agencies are required to send you a debt validation letter that lists out the above information. If you're still unsure about the debt in question, you can send a verification letter requesting further details. Usually, the validation letter has to come within five days of first contact.

How to Write a Debt Verification Letter

If the validation letter fails to answer your questions, or you don't receive it in the first place, you can send a verification letter requesting proof of debt. The letter comes in handy if you plan to pay the debt or are facing an aggressive collections agency like Altus. Here is an example of a debt verification letter:

Your name

Your Address, City, State, Zip

RE: Debt Account Number (if available)

Dear Altus GTS, Inc.

This letter is being sent to you in response to the notice sent to me on [date] regarding a debt. Be advised that this isn't a refusal to pay but a notice to request validation.

Under the Fair Debt Collections Practice Act, 15 USC 1692g, Sec. 809 (b), I have the right to request validation of the debt you claim I owe.

Be advised I am not requesting a "verification" but a "validation," that is, competent evidence that I have a contractual obligation to pay you. Until then, please cease all communication with me and note on your records that I dispute any responsibility for this debt.

I'll also inform you that if your offices have or continue to report this invalidated information to a credit bureau, they are committing fraud under state and federal laws. For this reason, I will not hesitate to take legal action against you or your client if I find a negative mark on my credit reports.

If your offices provide the requested information, I will need 30 days to assess the details and expect you to stop any collection activity. If you take any action that could negatively affect my credit reports during the validation period, I will seek legal help for a lawsuit.

Please respond within 30 days of receipt. If you fail to do so, you should delete all references to this account and altogether remove them from my credit file and send a copy of such deletion to me immediately.

Sincerely

[Name]
